The independent entertainment label and emarketing outlet, Sincere (Recordings & Management) UK, is a legit small business that is a private unlimited company that has a registered membership with PPL UK and is a member of AIM – the Association of Independent Music. AIM Represent over 900 independent labels and distributors across the UK, giving them a voice and helping them to succeed. Sincere is now a registered sole trader with MCPS and PRS for music publishing. As a registered individual the small business is based in, BANES Somerset UK. A city with a community full of Rap & Hip-Hop collectives working within the area codes of BA1 and BA2 of Bath city. Somerset also offers Drum & Bass artists, producers and D.J’s plus many other genres of very talented underground performing artists.

Sincere performers and or artists are representatives of the independent recordings and management label. The label has several artists for the audio visual media they have submitted. All reps are in control of their own media creativity, marketing, performances and media rights. They are not permitted to share any percentage of their royalties with the proprietor. Artists are self-employed performers and work when they want to. Sincere is a attitude, a way of life, a self made career and status all of it’s own. Our way of living as artists and or reps of Sincere is bohemian and what we make of our own time and energies is up to us.

Respective Roles

Today, Sincere music publishing is only concerned with the administering of copyrights, licensing songs to record companies and others and collecting royalties on behalf of the songwriter. Some of the more important music publishing activities are listed below.

Mechanical Royalties

The term “mechanical royalties” initially referred to royalties paid whenever a song is reproduced by a mechanical device (remember that one of a copyright owner’s exclusive rights is the right to authorize the reproduction of their work). The term “mechanical royalties” was applied to the reproduction of songs in music boxes, player pianos rolls, and later, phonograph records. This term is still used, and “mechanical royalties” now refers to royalties paid for the reproduction of songs on CD, DAT, Mini Disc, audio cassette, musical greeting cards, and other devices sold on a “per unit” basis.

Foreign Monies

Foreign countries sometimes have different laws governing the collection and distribution of mechanical royalties. As a result, it is often necessary for publishers to enter into agreements with a foreign publisher (or “sub-publishers”) to collect a songwriter’s mechanical royalties in that territory. Foreign income is not divided between the publisher and the songwriter.

Synchronisation Licenses

Whenever a song is used with a visual image, it is necessary to obtain a “synchronization” (or “synch”) license permitting the use of that song. Music publishers issue synch licenses to television advertisers, motion picture companies, video manufacturers and CD-Rom companies. A portion of this money (usually 1/2 the net proceeds) is paid to the songwriter.

Transcription Licenses

Because radio is not a visual medium, the use of a song as part of a radio commercial requires a separate license, known as a “transcription license.” Sometimes songwriters are able to negotiate provisions in their publishing contract preventing their songs from use in certain contexts, such as ads for alcohol, tobacco, political campaigns or other uses the songwriter may find offensive.

Other Roles

Print Licenses

Although sheet music sales have diminished over the years, many songs are still available in print form. These include books of songs by specific artists, instruction books or compilations of hits within a given genre (i.e., “Motown Classics – for Keyboard”). The music publisher issues print licenses and collects this income from the sheet music company, while the songwriter receives a small royalty derived from the sale of his or her song in print form.

Administration and Registration of Copyrights

Because music publishers generate money by licensing copyrighted compositions, they must also perform various administrative tasks involving copyright transfers and the registration of musical copyrights. Registering your copyright provides added protection to copyright holders, and can permit the copyright owner to recover statutory damages and solicitor fees if the copyright is subsequently infringed.

Public Performance Royalties

A copyright owner also has the exclusive right to authorize the “public performance” of that work. This is why radio and television broadcasters must enter into licenses with performance rights organizations such as BMI, ASCAP and SESAC. These performance rights organizations collect income on behalf of songwriters and music publishers whenever a song is publicly broadcast.

Publishers also register songs with these performance rights organizations.

“Song Plugging”

This obscure term refers to music bizzers who promote the compositions of others. This may involve convincing popular artists to cover your song, or convincing film companies to use your latest tune in their next feature.

All Leasing & Exclusive Rights for an artist’s MP3’s comes at a price to those seeking to lease or gain exclusive rights of any of our artists music.

LEASING RIGHTS

You will receive an encoded MP3 file of the untagged song, and/or a copy of the raw WAV file. The song file can be delivered digitally or through the mail on a CD. Leasing rights allow you to use the beat (or song) for ONE commercial recording or broadcast. This recording can then be distributed at your price for up to 2,000 copies. Selling more than 2,000 copies means you must acquire a new lease or exclusive rights. You may also use the beat for non-profit promotional use or demos. You have full rights to record, alter, mix the beat/song in any shape, way, or form (except reselling the beat). You will receive a contract in the mail granting you non-exclusive rights to the beat. In the event that someone buys exclusive rights to the beat you have leased, your rights shall stand and the beat is still yours to use. You may also acquire new leasing rights if you sell more than 2,000 copies since your contract predates exclusive sale. The seller will not receive a royalty from the sale of records or downloads. You must however give full credit to the seller (artist and/or producer name) on all commercial recordings. Upon purchasing leasing rights, the seller still owns the beat(s) and the seller is able to resell the beat(s) to any other party until exclusive rights have been purchased.

EXCLUSIVE RIGHTS

You will receive a MP3 file of the beat (or song), untagged (free of sound marks) and/or a copy of the raw WAV file. The song file can be delivered digitally or through the mail on a CD. Exclusive rights grant you unlimited commercial recordings and broadcasts. You have full rights to record, alter, mix the beat/song in any shape, way, or form (except reselling the beat). You will receive a contract in the mail granting you exclusive rights to the beat. You own the recording as a “work made for hire”. The original seller may no longer lease or sell the beat/song, except for prior leasing rights holders and his/her own promotional page (no downloads there). The seller will not receive a royalty from the sale of records or downloads. You must however give full credit to the seller (artist and/or producer name) on all commercial recordings.

SPECIAL USES: TV, Movies, Commercials, Websites

Charity organizations: can use song for free, but must give full credit to the artist and or producer.

Student projects for school/college: can use song for free, but must give full credit to artist and or producer.

Commercials, In-house, company publications: for publications with less than 50,000 viewers exclusive rights suffice. Terms are to be discussed for larger publications.

Websites (less than 100,000 monthly hits): leasing rights suffice

Websites (other): must acquire exclusive rights

TV/Movie: terms are to be discussed

Creative Common Licenses

With a Creative Commons license, the artist keeps the copyright, but allows you to copy and distribute the artist’s work provided you give the artist credit — and only on the conditions specified here. These licenses are free, so you don’t pay for them.

Sincere Personal License

This is the independent recordings and management personal license for “Sincere” UK. These high definition mp3 and or mp4 audio visual mastered mixes represent material submitted by self employed artists and or performers of Sincere. Every artist involved in Sincere entertainment has created digital media performances whilst in control of their own creativity & marketing. Each artist is not permitted to share any percentage of ones royalties, be that, quarterly earnings from broadcasters or live performances, plus any media rights revenue, with the proprietor or other administration managers. It has been deemed imperative that artists of Sincere do not overlook or alter their data’s media licenses or the stats to any or all purchased downloads from any account/s. What is provided as a purchased and or downloaded format and or any promotional format is contained here in and may be used for personal use, broadcasts and are not for resale. You must preserve the artistic name and title of the music that you may burn onto compact disc/s and give away for free only. You must make a copy of this license available with the music, images, videos, lyrics and web stuff. All sampling is prohibited without the artists explicit consent as the artist asserts copyright on this material provided.
